OhWaiter Referral Program Terms & Conditions
Effective for Qualified Referrals submitted on or after June 19, 2021
These Terms and Conditions (the “Terms”) apply to OhWaiter’s Referral Program (the “Program”). By submitting a referral for a restaurant or otherwise participating in the Program, you agree to be bound by these Terms.
Program Eligibility
Who is Eligible to Participate?
OhWaiter employees, active employees of an existing OhWaiter customer, consultants, investors, and friends who refer a restaurant to OhWaiter for SMS texting services (“services”) by email, to an OhWaiter Account Executive may be eligible to receive a $250 bonus payout.
Who is Not Eligible to Participate?
Restaurant owners, operators, or decision-makers responsible for making purchasing decision referring their own restaurants;
Franchisors responsible purchasing decision referring their own franchisees; and
Individuals who are under 18 years old.
Referral Requirements
Subject to these Terms, for each “Qualified Referral” that meets the following criteria, you will receive the applicable Bonus Payout listed below. A “Qualified Referral” is a restaurant that:
You refer to OhWaiter by email to an OhWaiter Account Executive;
is not an existing lead in the OhWaiter system; and
enters into a Merchant Agreement Initial Order Form with OhWaiter for services, and has been live, and paying for the OhWaiter platform for at least 3 months.
Verbal referrals will not be accepted.
OhWaiter reserves the right, in its sole discretion, to determine the original lead source.
Bonus Payouts
OhWaiter employees, active employees of an existing OhWaiter customer, consultants, investors, and friends shall receive a bonus payout of $250 for each Qualified Referral.
Bonus payouts will be made by checkt. Referrer must provide a W-9 in order to receive the bonus payout and timely payment of the bonus payment.
Limit of one Bonus Payout per restaurant brand or group. A restaurant brand or group is defined as either a franchise group or corporate entity and its affiliates.
Subject to the terms herein, there is no limit to the number of referrals an individual can submit, or eligible bonus payouts for Qualified Referrals an individual can receive, while the Program is in effect.
OhWaiter will determine, in its sole discretion, whether a referral is a Qualified Referral eligible for a bonus payout and reserve the right to disqualify any referrer at any time from participation in the Program for reasons including but not limited to OhWaiter’s good faith belief that referrer has violated these terms.
Limited Time Offer
With respect to each restaurant brand or group (as defined above), for any Qualified Referral submitted between June 1, 2021 and September 31, 2021, an individual is eligible for a bonus payout as set forth above for the first Qualified Referral (as defined above) and $250 per each subsequent Qualified Referral for up to five (5) Qualified Referrals. Each Qualified Referral must enter into a Merchant Agreement Initial Order Form with OhWaiter for SMS texting services, and go live and paying for the OhWaiter platform for at least 3 months.
Modifications
OhWaiter reserves the right to modify these Terms or terminate the Program at any time, in its sole discretion, without notice.
